Terms of the License to use

IOCŽ IPSŽ, OPSŽ, CPSŽ, RPSŽ, FPSŽ, logos and their designs.

IOCŽ Realty Specialist Inc., a Nebraska Corporation, hereinafter called "IOCŽ".  By completing this form and becoming an IOCŽ Network Licensed Member, I hereby agree that all trademarks and tradenames of IOCŽ remain the property of IOCŽ and that I will complete all future IOCŽ Network Association Information Forms.

Trademark Licensing Agreement & Network Membership with the IOCŽ Network and its associated documentations contains 
copyrighted and proprietary information protected by the laws of the United States Trademark Office. The Licensed Trademarks and Designs are the sole property of IOCŽ.
 
IOCŽ grants you, the Network Member Licensee, a non-exclusive and non-transferable license, and the right to use the Licensed Trademarks and Designs. Your right to use the Licensed Trademarks and Designs terminates upon the violation of any provision of this License. If any provisions of this License is held to be unenforceable, such holding shall not affect the enforceability of any other provisions hereof. Licensed Trademarks and Designs are the IOCŽ Licensed Trademarks and Designs and any associated documentation.

Single User:  If you have not purchased a territory that is clearly designated as a territory, the Licensed Trademarks and Designs can only be used by you only, therefore, you can not shared the trademarks or designs with any other person, unless specially authorized in writing and notarized allowing you to do so.
 
Your license grants you to use the Licensed Trademarks and Designs solely for marketing purposes of yourself to the general public.

The Licensed Trademark and Designs are provided "as is" without warranties of any kind either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other that those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.  IOCŽ does not warrant that the Trademarks and Designs contained in the Licensed Trademarks and Designs will meet your requirements or that the operation of the Licensed Trademarks and Designs will be error free.  Should the Licensed Trademarks and Designs prove to be unsuitable for your or your operation, you (and not IOCŽ) assume the cost of adjustments, repair, correction or discontinued use.  No oral advice or written information given by IOCŽ , its employees, licensers or the like, shall create a warranty; nor shall you rely on any such information or advice.  

Upon request of IOCŽ, You agree to defend, indemnify and hold harmless IOCŽ its officers, directors, employees, agents and licensees, from any claims and expenses, including reasonable attorney's fees, in connection with your use of the IOCŽ Service and Trademarks and Designs.

This Agreement shall be governed by the laws of the State of Nebraska (excluding choice of law rules).  This Agreement constitutes the entire agreement between you and IOCŽ with respect to your Association with IOCŽ its Service, trademarks or designs.  IOCŽ's failure to enforce any provision hereof shall not be construed as a waiver of any provision or right.  In the event that a portion of this Agreement is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

Failure to have your licence fee paid is automatic termination of your partnering with the IOCŽ Network and will cease using the Licensed Trademarks and Designs and any associated documentation.

I agree to the above and would like to be Licensed to use the IOCŽ Network trademarks:

IOCŽ,IPSŽ, OPSŽ, CPSŽ, RPSŽ, FPSŽ, Logos and Designs .

The IOCŽ Licensing fee in the Network Membership (IN U.S.CURRENCY) for 2003 is Thirty ($30.00) Dollars per month, payable as $360.00 for a 12 month period, and becoming an IOCŽ Network Member and using the Licensed Trademarks and/or Designs of the IOCŽ Network. Submit this form to be a Licensed Member within the IOCŽ Network Association or print the form first then fill it out and mail it with your yearly twelve month fee.

I am completing this form to become a Licensed networking member with the IOCŽ Realty Network, I agree to the above and have made a copy for my files before submitting this form to IOCŽ.
