UNLESS YOU HAVE ANOTHER AGREEMENT DIRECTLY WITH IOCŪ THAT CONTROLS AND ALTERS YOUR USE OR DISTRIBUTION OF THE IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage, THE TERMS AND CONDITIONS OF THE APPLICABLE LICENSE AGREEMENTS APPLY TO YOU. Please read the agreements applicable for the trademarks and products you want to use. By completing this form and becoming an IOCŪ Licensed user, you hereby agree that all IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage remain the property of IOCŪ and that I will complete all future IOCŪ Licensing Forms to keep my License agreement in full force. Trademark Licensing Agreement & Network Membership with the IOCŪ Network and its associated documentation's copyrighted and proprietary information protected by the laws of the United States Trademark Office. The Licensed Trademarks and Designs are the sole property of IOCŪ. IOCŪ grants, you, the Licensed Member a Licensee of a non-exclusive and nontransferable "IOCŪ DFS" license, and the right to use the IOCŪ "DFS". Your right to use this "IOCŪ DFS" upon the violation of any provision of this Licensing Agreement. If any provisions of this License Agreement is held to be unenforceable, such holding shall not affect the enforceability of any other provisions hereof. Licensed Trademarks, Designs and "IOCŪ DFS" are the sole property of IOCŪ associated licensing documentation. Single User: If you have not purchased a territory that is clearly designated as a territory, the IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage can only be used by you, therefore, you can not shared the IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage with any other person or entity, unless specially authorized in writing and notarized allowing you to do so. Your license grants you to use the IOCŪ Licensed "IOCŪ DFS" solely for improving your investment knowledge and marketing purposes of yourself to a Buyer or Seller and the general public. The IOCŪ Licensed Trademarks, Designs, Brands, Products and Data Form Storage are provided "as is" without warranties of any kind either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other that those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. IOCŪ does not warrant that the, IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage contained in the Licensed Trademarks and Designs will meet your requirements or that the operation of the Licensed IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage will be error free. Should the Licensed IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage prove to be unsuitable for your or your operation, you (and not IOCŪ) assume the cost of adjustments, repair, correction or discontinued use. No oral advice or written information given by IOCŪ, its employees, licensers or the like, shall create a warranty; nor shall you rely on any such information or advice. Upon request of IOCŪ, You agree to defend, indemnify and hold harmless IOCŪ its officers, directors, employees, agents and licensees, from any claims and expenses, including reasonable attorney's fees, in connection with your use of the IOCŪ Services, Designs and/or Products. This Agreement shall be governed by the laws of the State of Nebraska (excluding choice of law rules). This Agreement constitutes the entire agreement between you and IOCŪ with respect to your Association with IOCŪ its Service, Designs and Products. IOCŪ's failure to enforce any provision hereof shall not be construed as a waiver of any provision or right. In the event that a portion of this Agreement is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect. Failure to have your IOCŪ Licensed Trademarks, Designs, Brands, Products and Data Form Storage Yearly Subscription License Fee paid is automatic termination of your licensing of the IOCŪ Trademarks, Designs, Brands, Products and Data Form Storage you will cease using the IOCŪ Licensed, Trademarks, Designs, Brands, Products and Data Form Storage and any associated documentation. I agree to the above and would like to be Licensed to use the IOCŪ, Trademarks, Designs, Brands, Products and Data Form Storage: "IOCŪ DFS". The IOCŪ "DFS" Licensing fee is a $100.00 value. Now the IOCŪ "DFS" file use will be Fifty Nine ($59.99), until March 2011, in (U. S. CURRENCY) Dollars per year, renewed yearly by you, payable via Paypal. I am completing this form to use a One (1) "IOCŪ DFS" Investment Property Form Tool for twelve (12) months renewable ever year until I cancel and I agree and understand that the form is always changing and updating and that enhancements are not guaranteed and accept it "as is" for the amount stated above and can cancel the on going subscription to the above and have made a copy for my files submitting this form to IOCŪ.
